ORDER

The petitioner, who apprehends arrest for the alleged offences punishable 1/4

under Sections 8(c) r/w 20(b)(ii)(B), 22(b), 25 and 29(1) of NDPS Act 1985, in Crime No.3 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of prosecution is that on 13.01.2025 while the respondent police were on patrol rounds near Balappanatham Village, they spotted a Tamil Nadu registered Car TN-07-W-7290 and on suspicion when they raided the said car, they found the petitioner along with other co-accused of having illegal possession of 10 KG of Ganja. Hence this case.

3. The learned counsel appearing for petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner along with other accused seized 10 KG of Ganja and the petitioner and other accused fled the scene of occurrence upon seeing the police party and no previous case is pending against the petitioner. He would also submit that if he is released on anticipatory bail, he would hamper the investigation and tamper the witnesses. However, he would vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances, the investigation is not yet completed and if he is released on anticipatory bail, there is possibility that 2/4

petitioner involve in similar offences, hence this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 06.10.2025 rna Note :
