This is the third bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 02.05.2022 for the offences punishable under Sections 376(3), 376(2)(n) and 506(1) of IPC, 1860 and Sections 5(l), 6 and 21(1) of the Protection of Children from Sexual Offences Act, 2012 in crime No.16 of 2022 on the file of the respondent police.
2. The case of the prosecution is that the petitioner compelled and committed rape on the victim girl aged about 15 years. Hence, the complaint.
3. Earlier, this Court dismissed the bail petitions filed by the petitioner in Crl.O.P.Nos.14293 & 16824 of 2022, on 27.06.2022 and 19.07.2022 respectively, considering the fact that the petitioner had committed very serious and heinous offence as against the minor victim girl.
4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner.
