This Criminal Original Petition is filed to quash the First Information Report in Crime No.05 of 2024 registered on 21.05.2024. 2.
The learned counsel appearing for the petitioner submits that the petitioner is a District Educational Officer at Harur and she has been falsely implicated in this case along with other accused. In the FIR no specific allegation is made against this petitioner. 3.
The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the investigation is at nascent stage and this petitioner and her husband who is arrayed as 11th accused been implicated in the complaint. Hence the police has caused notice to them under Section 41 A of Cr.P.C., to participate in the enquiry. Unless and until the investigation is completed, whether any cognizable offence committed by the petitioner cannot be decided. 4.
Taking note of the fact that the investigation is at nascent stage and the prosecution has to complete the investigation without any hindrance, this Criminal Original Petition to quash is dismissed without 2/4
adverting merits to canvas. Consequently, the connected Criminal Miscellaneous Petition is also dismissed.
