JUDGMENT

The learned Counsel for the Appellant submits that the Appellant was directed to execute sale deed as per the decree passed by the learned II Additional District Judge, Vellore at Ranipet in O.S.No.48 of 2018 dated 1/3

12.03.2020.

2. Aggrieved, the Defendant before the learned II Additional District Judge, Vellore at Ranipet in O.S.No.48 of 2018 had preferred this Appeal. Pending Appeal, an amount of Rs.45,00,000/- received from the Plaintiff in the suit was returned along with interest. Thereby retaining the property with the Defendant.

3. Both the parties present in Court. The Plaintiffs 1, 2 and 3 admitted that they received Rs.45,00,000/- along with interest. They did not insist for specific performance as per the decree dated 12.03.2020. The terms of compromise has been recorded. The Appeal is dismissed in the light of the compromise arrived between the parties. Refund of Court fee to the Appellant is ordered. Consequently connected miscellaneous petitions are closed.
