2022-07-29Honourable Mr Justice G.K. Ilanthiraiyan2 pages

Crl.O.P.No.17916 of 2022 Crl.O.P.No.17916 of 2022 G.K.ILANTHIRAIYAN, J.

This matter is posted today before this Court under the caption 'For Being Mentioned' at the instance of the learned counsel appearing for the petitioners.

2. The learned counsel appearing for the petitioners would submit that this Court, by an order dated 29.07.2022, has granted anticipatory bail to the petitioners in Crl.O.P.No.17916 of 2022. However, the learned counsel submitted that some typographical error has been crept in the order copy. Hence, he prayed for suitable directions.

3. Considering the submission made by the learned counsel appearing for the petitioner, para (4) and para(5) in the order copy are replaced as follows:

(4) The learned Additional Public Prosecutor would submit that initially a case was registered under Section 174 of Cr.P.C, thereafter it was altered for the offence under Section 306 IPC. He would further submit that due to work pressure given by the petitioners, the deceased committed suicide. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

(5) It is seen that initially, a case was registered under Section 174of Cr.P.C., thereafter altered for the offence under Section 306 of IPC. The deceased left the suicide note and on a perusal of the suicide note, it revealed that the petitioners are the superiors of the deceased. The deceased was working in YOROZU JBM TAMILNADU PVT LTD under the department of CNC as in-charge. While being so, the petitioners had fixed the work and also shifted the deceased from general shift to second shift. Therefore, the deceased committed suicide on the next day in this house. Therefore, there is no instigation by the petitioners soon before his death. Registry is directed to carry out the necessary correction and issue order copy afresh. However, time is extended for a period of two weeks from the date of receipt of copy of this order to comply with the conditions. 10.08.2022 Sma Crl.O.P.No.17916 of 2022 https://www.mhc.tn.gov.in/judis
