ORDER

This Writ Petition has been filed for the following reliefs:- "directing the respondent to pay the petitioner, interest towards belated

payment of earned leave and surrender leave salary and to pay a sum of Rs.18,500 payable towards STERBS (State Transport Employees Retirement Benefit Scheme), as admitted by the respondent in RTI reply dated 27.03.2026, together with interest at the rate of 15 percentage per annum, within a specified time frame as may be timed by this Hon'ble Court, award costs."

The case of the petitioner is that he had joined the respondent Transport Corporation on 22.08.1990 and after rendering several years of service, retired from service on 30.06.2018 on attaining the age of superannuation. However, the terminal benefits, namely, earned leave and surrender leave salary have been settled to the petitioner only on 26.02.2026 and no interest has been paid for the delayed period. That apart, the petitioner is also entitled to a sum of Rs.18,500/- towards STERBS (State Transport Employees Retirement Benefit Scheme), as admitted by the respondent in the RTI reply dated 27.03.2026. In this regard, the petitioner had submitted representations dated 16.02.2026 and 06.04.2026 to the respondents. Since the same were not considered, the present writ petition has been filed.

3. The learned Standing Counsel for the respondent would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondent to pay interest at the rate of 6% per annum for the belated payment of the eligible and admissible terminal benefits such as, Earned Leave Salary, Surrender Leave Salary and STERBS amounts, from the date of retirement till the date of actual disbursal of the said terminal benefits to the petitioner, within a period of six weeks from the date of receipt of a copy of this order.
