PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 1 to 3 to consider and decide the representation of the petitioner dated 20.07.2022 and preventing the 5th and 6th respondents from encroachment constructing a temple in the common pathway in S.No.124 on merits and in accordance with law.

Mr.T.Arunkumar, Additional Government Pleader [R1 to R3] Mr.S.Kumaresan [R4] Ms.I.Benish for Mr.M.Dinesh[R5 and R6] Order [Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ petition has been filed to direct the respondents 1 to 3 to consider and decide the representation of the petitioner dated 20.07.2022 and to restrain Respondents 5 and 6 from encroaching upon the common pathway in S.No.124 by constructing a temple.

2. The learned Additional Government Pleader appearing for the respondents 1 to 3, based on the written instruction given by the Revenue Thasildar, submitted that during the course of survey, the revenue authorities has identified encroachments in the car track and a temple is under construction in the car track area as well as in the Government land. Thus, the respondents 1 to 3 are directed to initiate enforcement action and remove the encroachment by following the procedures as contemplated 2/4

under the relevant statutes and rules in force and after affording an opportunity to the alleged encroachers, if any illegal or unauthorized construction is found, the said building are directed to be removed by following the procedures.

3. The said exercise is directed to be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

Accordingly, this writ petition stands disposed of. No costs.
