8. P.S.Rahul .. Respondents Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus to direct the investigation now at the hands of the respondents 1 to 5, pertaining to the complaints against the petitioners, vide FIR Nos.120 and 336 of 2024, is either transferred or changed to any other agency, namely CBI, CBCID or any Special Police Team to investigate the matter afresh and file a final report and consequently for taking action against such erring Police official, namely the fifth respondent herein. ORDER
The petitioners have filed the present Writ Petition praying for issuance of a Writ of Mandamus to direct the investigation, now at the hands of the respondents 1 to 5, pertaining to the complaints against the petitioners, vide FIR Nos.120 and 336 of 2024, which is either transferred or changed to any other agency, namely CBI, CBCID or any Special Police Team to investigate the matter afresh and file a final report and consequently for taking action against such erring Police official, namely the fifth respondent herein.
2. The petitioners have filed this petition for transfer of investigating agency. Already, the existing investigating agency has completed the 2 / 4
investigation and filed the charge sheet. Hence, in the above facts and circumstances, there is no need to transfer the investigation to any other investigating agency. Hence, this petition is dismissed, with liberty to the petitioners to work out their remedy in the manner known to law. Consequently, W.M.P.No.33864 of 2024 is ordered on payment of separate Court fee by each of the petitioners. W.M.P.Nos.33866 and 33869 of 2024 are closed. 27.11.2024 cs To
