O R D E R

This Writ Petition has been filed seeking for a direction directing the respondents 2 to 5 to fix the guideline value for the petitioner's property at the rate of Rs.3230/- per square metre in main Survey No.14 and its sub-divisions in Thunjam Village, Thirukazhukundram Taluk, Kanchipuram District.

2. The grievance of the petitioner is that the petitioner's land was acquired by the State Highways department for the purpose of developing infrastructure and widening the State Highways road No.SH.58, under Sathurangapatnam to Chengalpattu road development Scheme. While passing the award, the value of the petitioner's land was fixed at Rs.840/- per square metre as per the guideline value fixed by the respondents 2 to 5. Whereas, for the neighbouring lands, the guideline value was fixed at Rs.3,230/- per square metre without any reason whatsoever. While passing the award, the Acquisition Officer has also stated that the guideline value has been unequally fixed. In the said circumstances, the petitioner has sent a representation dated 09.07.2018 to the respondents requesting to refix the guideline value at Rs.3,230/- per square metre instead of Rs.840/- per square metre, but so far no order has been passed in the representation. Hence, the petitioner has filed the present Writ Petition.

3. Mr.T.M.Pappaiah, learned counsel appearing for the respondents 2, 7 and 8 has submitted that already the petitioner's representation is pending with the 1st respondent and now, the Committee is constituted and the Committee will consider the petitioner's representation and pass suitable orders.

4. On considering the fact that the representation of the petitioner is pending, the 1st respondent is directed to refer the same to the Committee, and consequently, the Committee is directed to consider the petitioner's representation and pass suitable orders on merits and in accordance with law after giving opportunity to the petitioner within a period of twelve weeks from the date of receipt of the copy of this order.

5. With the above direction, the Writ Petition stands disposed of. No costs.
