Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, to direct the respondents to pass final orders in respect of two Charge Memos viz., Charge Memo in Na.Ka.No.2691/2006/A1, dated 29.06.2006 and Charge Memo in Letter No.17481/2004/A4-1, dated 12.06.2008 passed by the first respondent and fixing an outer time limit. O R D E R

Heard Mr.P.Ganesan, learned counsel appearing for the petitioner and Mr.P.Chinnadurai, learned Government Advocate, accepting notice on behalf of respondents. With the consent of the learned counsel on either side, the Writ Petition itself is taken up for final disposal.

2. The petitioner has filed the Writ Petition to direct the respondents to pass final orders on the Charge Memos issued by the first respondent to the petitioner dated 29.06.2006 and 12.06.2008.

3. Since the petitioner was charged with the Criminal Offence before the Special Court at Cuddalore in Special Case No.2 of 2009, based on a complaint lodged by the Inspector of Police, Vigilance and https://hcservices.ecourts.gov.in/hcservices/

Anti-Corruption, Cuddalore, the Charge Memos were not proceeded with, presumably at the instance of the learned counsel for the petitioner. The said Special Case No.2 of 2009, ended in acquittal, by judgment, dated 28.12.2015. Owing to the above facts, though the petitioner was attained superannuation on 30.06.2016, he was permitted to retire, as one day prior to retirement, Charge Memos were issued.

4. It is stated that the petitioner has already submitted his explanation to the Charge Memos. In the light of the above, there will be a direction to the first respondent to appoint an Enquiry Officer and proceed to conclude the Disciplinary Proceedings initiated against the petitioner, within a period of four months from the date of receipt of a copy of this order. It is needless to state that the petitioner should co-operate for expeditious disposal of the Disciplinary Proceedings.

5. With the above direction, the Writ Petition is disposed of. No costs.
