Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to act upon the letter forwarded by the second respondent vide his proceedings in Na.Ka.No.3068/2024/B2 dated 28.02.2025, whereby, directing to issue patta in the name of this petitioner pertains to his property comprised in S.No.346/4A, for Plot No.319 for an extent of 1800 sq. ft.

ORDER
By consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition has been filed seeking a writ of mandamus to direct the first respondent to act upon the letter forwarded by the second respondent vide the proceedings dated 28.02.2025.

It is submitted by Mr.K.Anbarasan, learned counsel appearing for the petitioner, that the petitioner is the lawful owner of the property comprised in S.No.346/4A (Old S.No.346/4A1B, New S.No.346/30) situated at Minjur Village, Thiruvallur District. It is submitted that the above property was purchased by the petitioner vide registered sale deed bearing Document No.4951 of 1991 and the petitioner has been in peaceful possession and enjoyment ever since.
4. While so, the petitioner had taken out an application for issuance of patta in his name in respect of the subject property. It was only then the petitioner came to understand that the patta has Page No.2 of 6
been issued inadvertently in the name of one R.Pounraj, who has no right, title of inherent over the subject property.

Mr.A.Selvendran, learned Special Government Pleader for the respondents would submit that if it is a case of rectification of the entry made in the UDR, the proper Authority is the District Revenue Officer, however, the petitioner had taken out an application only before the Tahsildar and the Revenue Divisional Officer. Therefore, it is only appropriate that the petitioner takes out appropriate application/representation before the District Revenue Officer, seeking rectification of the errors, which according to the petitioner is inadvertent insofar as the name in which the patta stands in respect of the subject property.

The learned Special Government Pleader would further submit that if any such application is taken out before the District Revenue Officer, who is the appropriate Authority, the same would be considered and appropriate orders would be passed, on its own merits and in accordance with law, after hearing the petitioner and any other interested parties, including Mr.R.Pounraj, within a period of sixteen weeks from the date of receipt of such representation. 7. The learned counsel for the petitioner would then submit that he would take out an application before the District Revenue Officer.
8. Recording the same, the present writ petition stands disposed of. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. There shall be no order as to costs.
