This Criminal Original Petition has been filed to direct the respondent to file the final report in Crime No.04/AC/2023 dated 04.05.2023 on the file of the respondent Police.

2.The case of the prosecution is that the President of Nadupaty Village namely, Jothiswaran had misappropriated public beneficial scheme funds sanctioned for various projects at Nadupatty Village Panchayat. Hence, the petitioner made a complaint before the respondent on 18.05.2020. After conducting an enquiry, a case in Crime NO.04/AC/2023 was registered against the public servant.

The learned counsel for the petitioner submitted that after registering the First Information Report, the respondent Police did not take any further steps for completing the investigation and also not secured the accused for investigation. Since there was inaction on the part of the respondent for completing the investigation, the present petition has been filed. 4.The learned Government Advocate (crl.side) submitted that the total misappropriation amount to the Government was Rs.44,27,202/-. He further submitted that more than 70 witnesses are to be examined and the involvement of other officials are to be finalized. He also submitted that the check period 2/4
involved in this case is almost 10 years. Hence, there may be a direction to the respondent Police to file a final report by one year. 5.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record. 6.Considering the reasons and the request made by the investigating agency, this Court feels it appropriate to direct the respondent police to complete the investigation and to file a final report, within a period of one year from the date of receipt of a copy of this order.
7.With the above directions, this Criminal Original Petition is disposed of.
