PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to Letter No.AE/O&M/Tharai/File SFSR/A.No.027/14 dated 25.01.2014 - on the file of the 2nd respondent herein, quash the same and consequently direct the respondents 1 and 2 herein to effect electricity service connection for petitioner's Registration No.73 dated 02.05.2009 for S.No.188/4, Desavilakku North Village as per the direction made in last paragraph of the letter dated 29.08.2013 made in letter No.AEE/O&M/Tharai/File Complaint/No.187/2/2013 - on the file of the 1st respondent herein.

O R D E R
The order impugned dated 25.01.2014, asking the petitioner to pay a sum of Rs.83,420/- for providing additional Cable wire for the purpose of Electricity service connection in the premises of the petitioner is under challenge in the present writ petition.

It is not in dispute that the petitioner had made a request for providing Agricultural Electricity Service Connection through an alternate route, in view of the objections raised by the other agriculturists from the main line. Therefore, the Board authorities have to provide additional cable through an alternate route for the purpose of providing Electricity Service Connection to the petitioner. In this regard, an assessment was made and accordingly, the Assistance Engineer passed an order on 25.01.2014, stating that the petitioner has to pay a sum of Rs.83,420/-(Rupees Eighty Three Thousand and Four Twenty) for the purpose of providing Electricity Service Connection through an alternate route.
3. The additional charges are demanded to comply with the request made by the petitioner for providing Agricultural Electricity Service Connection through an alternate route, in view of the objections raised by the other persons to provide connection from the main route.
4. This being the factum established, the petitioner is bound to pay the additional cost for the purpose of providing cable through an alternate route for providing Electricity Service Connection and it is for the petitioner to take a decision in this regard. In the event of providing connection, the petitioner is bound to pay the demanded amount.
5. In this view of the matter, this Court do not find any infirmity as such in respect of the demand made by the respondents towards the additional costs for installation of electricity cable wire for providing connection through an alternate route.
6. With these observations, the writ petition stands dismissed. No costs.
