ORDER
These writ petitions have been filed against the impugned proceedings of the respondent dated 26.05.2026.
2. Mr.M.Guruprasad, learned Government's counsel, takes notice on behalf of the respondents in all the cases.
3. By consent of the parties, the main petitions are taken up for disposal in the stage of admission itself.
4. The learned counsel for the petitioner would submit that in this case, the petitioner made an application for the purpose of sub-division of subject property and issuance of separate Patta based on the settlement deed and sale deed. However, without considering the said representation in proper manner, the respondent had passed the impugned orders.
5. Further, he would contend that the impugned orders were passed by the respondents as a non-speaking order, without conducting any proper enquiry, which is nothing but a violation of principles of natural justice. Hence, this petition.
6. In reply, the learned Government's counsel appearing for the respondent had confirmed the submissions made by the petitioner and requests this Court to pass appropriate orders.
7. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.
8. In the case on hand, upon perusal, it is apparent that the impugned orders were passed as a non-speaking order without conducting any proper enquiry, which is a clear violation of principles of natural justice. In such case, there is no doubt that the said impugned orders are not sustainable in law and the same are liable to be set aside.
9. In view of the above, this Court passes the following order: i) The impugned orders dated 26.05.2026 are set aside and the matters are remanded back to the respondent for reconsideration
ii) The respondent is directed to issue notice to all the concerned parties and conduct a proper enquiry and thereafter, pass detailed speaking orders with regard to the issuance of separate patta.
