ORDER
This petition has been filed challenging the FIR registered in Crime No.25 of 2019 by the respondent police for the offence under Section 8 of the Tamil Nadu Gaming Act, 1930.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
3.The learned Additional Public Prosecutor submitted that the final report has not been filed till date in this case. The offence under Section 8 of the Tamil Nadu Gaming Act, 1930 is punishable with a maximum imprisonment of three months. However, the final report has not been filed till date. In view of the same, there will be bar to take cognizance of the final report even if it is filed today in view of the Section 468 of Cr.P.C. On this short ground, the FIR is liable to be interfered by this Court.
4.In the result, FIR in Crime No.25 of 2019 pending on the file of the respondent police is hereby quashed in its entirety. 5.In the result, this criminal original petition stands allowed. Consequently, connected miscellaneous petition is closed.
