The petitioner, who was arrested and remanded to judicial custody on 10.06.2022 for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C), 25 and 29 (1) of NDPS Act in Crime No.210 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 22.04.2022 at 10.00 a.m., during routine check up, the respondent police intercepted a vehicle bearing Registration No. TN 04 AU 5320 and found the accused persons in possession of 12 bundles of Ganja totally weighing to 26.703 Kgs and 1.045 Kg of Ganja oil. Hence, the case.
3. It is a commercial quantity. That apart, the petitioner failed to fulfill the twin conditions as contemplated under Section 37 of the NDPS Act. Therefore, this Court is not inclined to grant bail to the petitioners and this Criminal Original Petition is dismissed.
