A.No.3359 of 2021 in C.S.No.55 of 2016 N.SESHASAYEE, J.

This application is filed by the plaintiff to direct the defendant to produce three documents.

2.Learned counsel for the defendants submits that of the three documents, he got the photocopies of documents 1 and 3, which he is willing to produce.

3.Since, the Court cannot insist the party to bring the document, which he does not have necessarily this Court cannot grant the prayer as regards production of the 2nd document has to be closed. Unless the plaintiff chooses sometime during the trial or otherwise this respondent is in a position to produce the 2nd document as well.

4.The Defendants are now required to produce the documents 1 and 3.

5.Accordingly, this application is partly allowed.
