This is the second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 03.06.2022 for the offences punishable under Sections 363 & 366 of IPC and 5(l) r/w 6 of POCSO Act in crime No.359 of 2022 on the file of the respondent police.
2. The case of the prosecution is that under the pretext of love affair, the petitioner kidnapped the victim girl aged about 15 years and committed penetrative sexual assault on her. Hence, the complaint.
3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.16992 of 2022, on 21.07.2022, considering the fact that the petitioner had committed very serious and heinous offence as against the minor victim girl.
4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner.
