This application has been filed by the applicant / plaintiff seeking leave to file the present suit as against the respondents / defendants 1 to 4 in respect of the Schedule C and D properties which are situated outside the jurisdiction of this Court.

2. The suit has been filed by the applicant / plaintiff for partition of the suit schedule properties viz., Schedule A to D by metes and bounds and allot 1/4th share in the same to the plaintiff and for permanent injunction restraining the defendants, their men, agents, servants or any other person claiming under or through them in any manner from alienating, encumbering or in any manner dealing with the suit schedule properties.

3. According to the learned counsel for the applicant / plaintiff, the suit has been filed for partition against the defendants. Even though the cause of action is well within the jurisdiction of this Court, Schedule C and D of the suit schedule mentioned properties are situated outside the jurisdiction of this Court.
