.. Respondent On representation of the counsel for both sides, this case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.R.V.Sivaraj learned counsel for the appellant/Insurance Company and Mr.B.R.Sivasubramaniam, learned counsel for the first respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Aggrieved by the award made by the Motor Accidents claims Tribunal, (Special District Court No.1) at Cuddalore, the Insurance Company preferred the above appeal.

2. The representative of the appellant/Insurance company and the first respondent and the learned counsel for the first respondent are present before this Lok Adalat.

3. The parties have entered into a settlement, by which the first respondent is entitled for a sum of Rs.11,00,000/- (Rupees Eleven lakhs only) in full quit.

4. It is submitted by the appellant/Insurance Company that already a sum of Rs.8,23,690/- (Rupees eight lakh twenty three thousand six hundred ninty eight only) has been deposited before the Tribunal and they will deposit the balance amount within a period of four weeks from the date of receipt of a copy of this award. On such deposit, the first respondent is entitled for withdraw the same by filing an appropriate application before the Tribunal. The Civil Miscellaneous Appeals are disposed of accordingly.
