Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the 1st respondent to retain and preserve all records connected with the Complaint No.388/2025 dated 18.07.2025 refrain from transferring the disciplinary proceedings to the 3rd respondent under Section 36B of the Advocates Act, 1961 and discharge its statutory duty by proceeding with and concluding on merits a fair, impartial and time bound disciplinary enquiry into the complaint disclosing prima facie professional misconduct against the 2nd respondent Advocate, encompassing any further acts of misconduct against the 2nd respondent advocate, encompassing any further acts of misconduct that may emerge during the course of the enquiry and thereafter pass appropriate disciplinary orders in accordance with law, including removal of the name of the 2nd respondent Advocate from the rolls of advocates if so warranted upon enquiry and further award exemplary and compensatory costs.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This petition has been filed under Article 226 of the Constitution of India seeking a direction to first respondent not to

transfer the disciplinary proceedings to third respondent Bar Council of India.

2. Learned Standing Counsel for first respondent, on instructions, submitted that the election process is yet to be completed and after the constitution of the Council, the complaint will be taken up and considered in accordance with law. He further submitted that the disciplinary proceedings can be transferred only after one year of the transfer of the Disciplinary Committee, which is yet to happen.

3. In view of the aforesaid, this writ petition is closed. There shall be no order as to costs. Consequently, the interim applications are also closed.
