ORDER

This petition has been filed to relax the condition imposed on the petitioner in Crl.O.P.No.7165 of 2025, dated 12.03.2025 that the petitioner shall report before the learned III Additional District Judge, Coimbatore everyday at 10:30 a.m., until further orders. 1/4

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner was earlier granted bail by this Court in Crl.O.P.No.7165 of 2025 on 12.03.2025 with one of the condition that he shall report before the learned III Additional District Judge, Coimbatore everyday at 10:30 a.m., until further orders. He further submits that the petitioner is facing trial in S.C.No.240 of 2018 before the learned III Additional District Judge, Coimbatore. In fact, the petitioner earlier had obtained anticipatory bail at the stage of PRC. However, due to his absconding, NBW was issued against him. He also submits he had appeared only from 17.03.2025 to 30.04.2025, he failed to appear thereafter, causing the trial Court proceedings stalled. Therefore, the respondent police are now taking steps to cancel the bail application of the petitioner. Hence, he opposed to relax the condition imposed on the petitioner.

3. At this stage, the learned counsel for the petitioner produced the wound certificate of his mother and submitted that her mother was assaulted, sustained head injury and was hospitalised from 02.05.2025 to 07.05.2025 hence, he was unable to appear before the trial court. 2/4

4. The learned Government Advocate (Crl.Side) opposed the above submission stating that the petitioner's mother was hospitalised only for five days and the petitioner failed to appear for the entire month of May and has not appeared thereafter.

5. Considering the facts and circumstances of the case, nature of allegations, taking note of the submission made by the learned Government Advocate (Crl.Side), this Court is not inclined to entertain the petition. 6.Accordingly, this criminal miscellaneous petition stands dismissed. 10.07.2025 nr To The Inspector of Police Karumathampatti Police Station, Coimbatore District M.
