For Petitioner : Mr.M.Kalidoss (in all CRPs) For Respondent : Mr.R.Deepak (in all CRPs) COMMON ORDER Heard the learned counsel for the petitioner and the learned counsel for the respondent.
2. The petitioner / wife challenges the common order passed by the III Additional Principal Family Court, Chennai on 18.01.2024 2/6
permitting the father of the respondent / husband to represent his son in the matrimonial proceedings. Though elaborate submissions were made by the learned counsel for the petitioner / wife, contending that the petitioner has not chosen to file the affidavit of the principals, but all the affidavits of the principals were also signed only by the father and agent and there is also mis-match with regard to the dates on which the power of attorney was notarized, considering the submission of the learned counsel for the respondent that the respondent / husband is now willing to physically come down to attend the proceedings before the III Additional Principal Family Court, Chennai and he no longer requires the power agent to act on his behalf, I do not see any purpose in deciding these revision petitions, at this juncture.
3. In the light of the above, making it clear that the respondent / husband shall make himself physically available for the Trial of the matrimonial proceedings before the Trial Court. 3/6
4. These Civil Revision Petitions are disposed of with a direction to the III Additional Principal Family Court, Chennai to expedite the Trial. In O.P.No.4810 of 2022, the respondent / husband has been set ex-parte. However, an application has been filed to restore the said ex-parte order along with the counter. In so far as the application in O.P.No.1657 of 2023, the petitioner / wife is yet to file counter. The III Additional Principal Family Court, Chennai shall ensure that the pleadings are completed within a period of eight weeks from the date of receipt of a copy of this order and thereafter shall expedite the joint Trial in both O.Ps. It is made clear that the respondent / husband shall not fall back on the Power of Attorney or the applications filed seeking the agents / father to represent him to the above proceedings.
The respondent / husband has undertaken to appear in person and conduct the Trial. The learned III Additional Principal Family Court, Chennai shall endeavour to dispose of both the O.Ps., on or before 30.04.2026. The respondent is at liberty to file an application for seeking legal assistance, and if any filed, the physical presence of the respondent / husband shall not be insisted upon, except where it is absolutely necessary.
