Mr.A.Swaminathan (For R1) (in all applications) COMMON ORDER The present applications have been filed to permit to file documents listed in Annexure-A and receive and take on record the said documents as additional documents in the present rectification petitions.
2. Heard both sides.
3. It is submitted by the learned counsel appearing for the petitioner that the documents listed in item Nos.1 and 2 in the Judge's Summons are already on record as Ex.P12 series and, in that regard, the present applications are unnecessary insofar as the said documents are concerned.
4. The learned counsel appearing for the applicant would submit that the third item listed in the Judge's Summons would be required to prove the prior user and reputation of the applicant.
5. The learned counsel appearing for the respondent would submit that the said document does not have any relevance to the proceedings and hence he would seek this Court to reject the same.
6. However, considering the facts and circumstances of the case, item No.3 listed in the Judge's Summons can be taken on record, subject to proof of relevancy.
