When the matter is taken up for hearing, the learned counsel for the petitioner submits that the suit has already been decreed exparte against the revision petitioner and he has filed an application to set aside the exparte decree with a delay.

2. In view of the said submission made by the learned counsel for the petitioner, nothing survives in this civil revision petition for further adjudication.

3. Accordingly, the Civil Revision Petition is dismissed as infructuous. In case, the exparte decree passed against the revision petitioner is set aside and main suit is taken up for hearing again, the petitioner is entitled to revive the Civil Revision Petition. No costs. Consequently, the connected civil miscellaneous petition is closed.
