(CR.NO.41/2009) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the conditions imposed upon him by this Honble Court that the petitioner appear before V.Kalathur Police Station and signed before the respondent Police Station once in a week i.e. on every Monday at 10.30 am until further orders in Crl.M.P.No.8071 of 2021 dated 22.12.2020 pending disposal of the C.A.No.503 of 2020 and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. V.BALU, Advocate for the Petitioner and of MR.R.MUNIYAPPARAJ Additional Public Prosecutor on behalf of the Respondent the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J.) This petition has been filed to relax the bail condition imposed by this Court vide order dated 22.12.2020 passed in Crl.M.P.No.8071 of 2020 in Crl.A.No.503 of 2020.

This Court, by order dated 22.12.2020 in Crl.M.P.No.8071 of 2020 in Crl.A.No.503 of 2020, granted suspension of sentence and bail to the petitioner on certain conditions, one of which is that, the petitioner should report before the respondent/police once in a week i.e. on every Monday at 10.30 a.m. until further orders.

For relaxing the aforesaid condition, the petitioner has preferred the present petition.

Heard Mr.V.Balu, learned counsel for the petitioner and Mr.R.Muniyapparaj, learned Additional Public Prosecutor appearing for the respondent/State.

On instructions, the learned Additional Public Prosecutor submitted that the petitioner has been complying with the aforesaid condition since 04.01.2021.

In such view of the matter, this criminal miscellaneous petition stands allowed and the aforesaid condition is relaxed and modified as follows:

"The petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court." -sd/- 25/11/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
