The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 143(i)(a) of Railways Act, 1989 in Crime No. 275 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 8 number of Live E-Tickets valued Rs.29,178.4 and 11 number of expired E-Tickets valued Rs.26,322.40/- without valid license. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. On the confession statement of the co-accused, the petitioner was implicated in this case. Therefore, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that there are totally two accused involved in this case. The petitioner is arrayed as A2. The petitioner along with other accused person had created 90 fake IDs and purchased tickets from the railways and sold out to various customers. He would further submit that A1 was already

arrested and remanded to judicial custody. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner, the custodial interrogation of the petitioner is very much required, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 05.08.2022 Lpp
