Petition under Article 226 of the Constitution of India praying for issue of a Writ of Habeas Corpus directing the 2nd respondent to produce the body of the petitioner's daughter namely, Inthumathi, wife of Varatharaj, aged about 17 years, before this Hon'ble Court and hand over to the petitioner. (Order of the Court was made by M.M. SUNDRESH,J.) The present Habeas Corpus Petition has been filed by the mother of the detenue on the ground that she is missing. 2.
Pursuant to the complaint given by the husband of the detenue on 14.02.2020, the learned Additional Public Prosecutor https://hcservices.ecourts.gov.in/hcservices/
submitted that the detenue has been secured on 11.10.2020 at Thiruvannamalai and this was made known to the petitioner as well as the husband of the detenue. It is his further submission that enquiry was conducted in the presence of the detenue and her husband and during the enquiry, a statement was also obtained from the husband of the detenue. Learned Additional Public Prosecutor also submitted that the detenue is a major and she has declined to rejoin either the petitioner or her husband and she is living in Thiruvannamalai. 3.
Learned Additional Public Prosecutor has served a copy of the papers to the learned counsel for the petitioner. 4.
Considering the submissions made by the learned Additional Public Prosecutor, we do not find any purpose in keeping this petition pending and the same is closed. However, the respondent Police is directed to furnish the details and particulars pertaining to the place of residence of the detenue so that the petitioner could pay her a visit.
