COMMON PRAYER:

Civil Revision Petition filed under Section 24 of the Civil Procedure Code, to withdraw the cases in HMOP.No.2101 of 2024 and G.W.O.P.No.457 of 2025 on the file of the Principal Family Court at Coimbatore and to transfer the same to the file of the Principal Family Court at Salem, Salem District.

For Petitioner : Mr.V.Shanmugasundaram COMMON ORDER These Transfer Civil Miscellaneous Petitions are filed by the petitioner/wife seeking transfer of petitions for divorce and custody of the child filed by the respondent/husband in HMOP.No.2101 of 2024 and 1/4

G.W.O.P.No.457 of 2025 from the file of the Principal Family Court, Coimbatore, to the file of the Principal Family Court, Salem.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. According to the petitioner/wife, she is now living with her parents at Salem and the distance between Salem and Coimbatore is 165 kilometers. It is further stated that she is having a minor daughter and finds difficulty to travel from Salem to Coimbatore to attend each and every Court hearings and therefore, the instant petition has been filed.

4. It is settled law that in cases involving matrimonial dispute, the preference shall be given to the convenience of the petitioner/wife.

5. By taking into consideration the inconvenience expressed by the petitioner/wife in undertaking a travel to Coimbatore, this Court is inclined to allow the above transfer petition as prayed for. 2/4

6. Accordingly, the Transfer Civil Miscellaneous Petitions are allowed and HMOP.No.2101 of 2024 and G.W.O.P.No.457 of 2025 pending on the file of the Principal Family Court, Coimbatore are withdrawn and transferred to the file of the Principal Family Court, Salem. No costs. Consequently, connected miscellaneous petitions are closed.
