..Respondent(s) Prayer : The writ petition has been filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to pay the interest to the petitioner at the rate of 8% per annum on the delayed payment of provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension, and other retirement benefits payable to the petitioner's husband, for the period from 31.05.2025 to 11.03.2026 i.e., 285 days, within such time as may be fixed by this Court.

ORDER

The writ petition is filed for the below relief: "directing the respondents to pay the interest to the petitioner at the rate of 8% per annum on the delayed payment of provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension, and other retirement benefits payable to the petitioner's husband, for the period from 31.05.2025 to 11.03.2026 i.e., 285 days."

2. The brief facts which are culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioner that he was working as Selection Grade Driver under the respondent Transport Corporation and retired from service on 31.05.2025. The respondents settled the Provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension and other retirement benefits for the period of 31.05.2025 to 11.03.2026 i.e., 285 days with a delay. Therefore, the respondents are legally bound to pay interest to the petitioner. Therefore, the petitioner made a representation to the respondents to pay the interest at the rate of 8% p.a., for the belated payment of the petitioner's Provident Fund, Gratuity,

Surrender of Earned Leave Salary, Commuted Pension and other retirement benefits. Since there is no response, the petitioner is before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension and other retirement benefits has been paid belatedly for no fault of the petitioner. Therefore, the petitioner is entitled to interest on the same. Therefore, the Writ petition is disposed of with a direction to the respondents to disburse the 6% interest for belated payment of retirement benefits for the period from 31.05.2025 to 11.03.2026 i.e., 285 days on Provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension within a period of one (1) month from the date of receipt of a copy of this order. No costs.
