Respondent(s) Writ Petitions filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records in connection with proceeding in office memorandum Na.Ka.No.A5/913/2023 dated 07.08.2013 of the 4th Respondent and quash the same and consequently direct the 3rd Respondent to reinstate the petitioner as Block Coordinator with all back wages and salary benefits and other benefits.

ORDER

The learned counsel for the petitioner would submit that the petitioner was suspended from service on 07.08.2023 based upon the Criminal case registered against him in Crime No.34 of 2015. It is the contention of the petitioner that the above criminal case was subsequently entered in acquittal vide order dated 18.09.2017 by the learned Judicial Magistrate-II, Vellore.

2. According to the petitioner, the above Criminal case was against the petitioner and the 5th respondent. After the order of acquittal, the 5th respondent was reinstated but the petitioner was not considered. In this connection, he has sent representation to the 2 and 3rd respondents vide representation dated 18.10.2017 and 18.10.2024 and such representations are yet to be considered by them.

3. At this juncture, the learned Special Government Pleader appearing for the respondents 1 to 4 would submit that they will consider the said representation within a reasonable time.

4. In such view of the submissions, this Court without going into the merits of the case, deems it appropriate to direct the respondents 1 to 3 to consider the petitioner's representations dated 18.10.2024 and pass orders on its own merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
