Respondent(s) PRAYER This petition has been filed seeking for issuance of a Certiorarified Mandamus, to call for the records of the 4th respondent vide in his proceedings letter No.EA3 / F.372 / 2013 dated 17.06.2014 and quash the same and consequently direct the 1st respondent herein to regularize the service of the petitioners' with effect from their date of joining duty as Nominal Muster Roll employee and pay all the backwages with interest.

ORDER
Challenge in this writ petition is to the order dated 17.06.2014 vide letter No.EA3/ F.372/2013 issued by the 4th respondent. By the said order, the claim of the petitioners for regularization of their services came to be rejected, citing that they have not completed 10 years of service. 2.The learned counsel for the petitioners has submitted that although the claim for regularisation have been rejected, however, the respondents are not granting minimum time scale of pay of Rs.18,500/- per month applying 'equal pay for equal work' under Article 39 of the Constitution of India and the same is discriminatory as similarly situated persons have been extended with the said benefit under G.O.Ms.No.233, Public Works Department, dated 06.12.2019. 3.Mr.V.Nanmaran, the learned State Counsel has submitted that the petitioners' who are appointed as Daily Rated Casual Labourers and continued to work as on today have been extended with the benefit under G.O.Ms.No.233, Public Works Department, dated 06.12.2019. 4.The submissions of the learned State Counsel is taken on record.
5.In the light of the aforesaid submission, this writ petition stands disposed of, directing the respondents to grant minimum scale of pay with dearness allowance applicable to the petitioners as extended in favour of the similarly placed persons under G.O.Ms.No.233, Public Works Department, dated 06.12.2019 within a period of eight(8) weeks from today, if not already extended. No costs.
