.. Respondent Petition filed under Section 11 of the Arbitration and Conciliation Act, 1996, to appoint a suitable person as Sole Arbitrator in terms of the Apartment Buyer's Agreement dated 13.10.2009 to decide the disputes which have arisen between the petitioners and the respondent.

O R D E R

Despite best endeavours, the settlement could not be finalised. Learned counsel for the parties, thus, jointly state that an

Advocate may be appointed as the Sole Arbitrator to enter upon reference and adjudicate the disputes inter se the parties and that the arbitration proceedings may take place under the aegis of the Madras High Court Arbitration Centre.

2.I, thus, appoint Mr.Thriyambak J.Kannan, Advocate, present in Court, residing at No.18, Brindavan Street, M-1, Vadhula Apartments, Mylapore, Chennai 600 004, Mob.No.: 98846 24563, as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties. As requested, the arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre.

3.The original petition is, accordingly, allowed, leaving the parties to bear their own costs.
