2. Notice has been ordered upon the respondent, who has also been served and the description printed in the cause list. However, there is no appearance by or on their behalf.

3. In light of the averments contained in the affidavit filed in support of the Miscellaneous Petition, the delay of 29 days in filing Tax Case (Appeal) is condoned and this Miscellaneous Petition is ordered.

4. Registry is directed to number the Tax Case (Appeal) if it is otherwise in order and list the same for admission.
