ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 294(b) & 307 of IPC, in Crime No.228 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that petitioner/Accused-6 in Crime No.228 of 2021 had filed this anticipatory bail application. He contended that in this case, A3 had been granted anticipatory bail by this Court in Crl.O.P.No.14597 of 2025 by an order dated 08.05.2025. He further submitted that the petitioner was never arrested in this case and he was not aware about the pendency of the case. Now, after completion of investigation, charge sheet has been filed in PRC.No.123 of 2024 and 2/5

petitioner has been shown as an absconding accused. On strength of the same, the police has been searching for the petitioner.

3. Mr.R.Vinothraja, the learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is the sixth accused. Though PT warrant was taken to execute against the petitioner, who was remanded in another case, but the PT warrant could not be executed. On completion of investigation in PRC.No.123 of 2024, it has been shown as the petitioner was arrested during the trial.

4. Considering the submissions made, this Court finds that the petitioner was not arrested and straight away NBW was issued against him. Hence, this Court issues a direction to the petitioner to appear before the Committal Court to file a petition to recall and the trial Court to complete the recall warrant issued against the petitioner. 3/5

5. With the above direction, this Criminal Original Petition is disposed of.
