O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 465, 466, 468 and 471 of IPC, 1860 in Crime No.469 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. Today, there is no representation for the petitioner.

The case of the prosecution, as per the defacto complainant Latha, Inspector of Police, Prohibition and Enforcement Wing, is that on 20.10.2023, one Veluraj, Sub-Inspector of Police, received secret information and apprehended four persons, seizing 14.400 grams of ganja from them. Thereafter, he registered an FIR in Cr.No.724 of 2023 for the offences under Section 8(c) read with Section 20(b)(ii)(B) and Section 29 of the NDPS Act, 1985, at Anna Nagar Police Station and arrested the said four persons, who were then remanded to judicial custody.

Subsequently, the accused A4, namely Ajith Prakash, filed a bail petition before the Principal Special Court under the EC and NDPS Act in Crl.MP.No.8408 of 2023, and was granted conditional bail, pursuant to which he was released from prison. The case remained under investigation. On 13.09.2024, Ajith Prakash filed a quash petition before the Hon'ble Court in Crl.OP.No.23136 of 2024 in Cr.No.724 of 2023, on the ground that on 20.10.2023 he was in Odisha State, serving as a Constable (GD), CISF (No.230505357), in the Central Industrial Security Force, and that he was 2/6

not present in Chennai on the alleged date of offence. He contended that his name was falsely implicated in the case, and therefore filed the quash petition, which was pending investigation.

5. On 07.10.2024, Ajith Prakash appeared before the Senior Commandant at Sri Guru Ram Dass Jee International Airport, Amritsar. On that day, the said officer showed him the photographs of the arrested persons. Ajith Prakash identified that the arrested person was actually his brother, Suriya Dinesh, who had impersonated him and secured release on bail by falsely using his name and documents. Thereafter, the respondent police ascertained that the person originally arrested was indeed Suriya Dinesh, who had impersonated his brother Ajith Prakash. Upon further investigation, it was found that several criminal cases were already registered against Suriya Dinesh in Tirunelveli and Tenkasi Police Stations. Subsequently, Suriya Dinesh was arrested by Nallaajerla Police Station, Andhra Pradesh, in Cr.No.240 of 2024 for possession of 260 grams of ganja and was remanded to judicial custody in Andhra Pradesh. 3/6

Following this, the respondent police submitted an affidavit before the Hon'ble Court in Crl.OP.No.23136 of 2024 on 25.10.2024, and the Court directed the respondent police to record the statement of Suriya Dinesh. Accordingly, on 05.11.2024, the respondent police visited Andhra Pradesh, examined Suriya Dinesh in judicial custody, and recorded his statement, wherein he admitted that he had falsely used his brother's name. Hence, the present case.

7. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution and opposed for grant of anticipatory bail.

8. Considering the fact that the case of impersonation in the Court, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition stands dismissed. 28.08.2025 Vv To 4/6
