ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 25.07.2021 for the offences under Section 8(c), 20(b)(ii)(B), 29 of NDPS Act in Crime No.585 of 2021 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 25.07.2021 at about 8.00 hours, based on the secret information, the respondent police went to Valayampattu Lake at the back side of the Vediappan Kovil and secured the accused who has been selling ganja and seized 1.100kgs of ganja from him and arrested him. Hence, the law enforcing agency registered the case against the petitioner.
3. The learned counsel for the petitioner submits that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and the petitioner is in jail from 25.07.2021 Therefore, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl.Side) submits that accused had illegally sold the ganja and he was in illegal possession of 1.100 kgs of ganja. Hence he vehemently opposed for grant of bail https://hcservices.ecourts.gov.in/hcservices/
to the petitioner.
5. Considering the facts and circumstance of the case and also considering the submissions made by both counsel, this Court not inclined to grant bail, however, liberty is granted to the petitioner to file Statutory bail petition before the concerned Trial Court.
6. Accordingly, this Criminal Original Petition is disposed of with the above directions.
