Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to survey the property situated in Old Survey No.483/6, New Survey No.56/6C, Olaipadi Village, Kunnam, Perambalur District and rectify the extent of the property in the field map sketch pursuant to the petitioner's representation dated 21.08.2024. ORDER

By the consent of both parties, the present writ petition is taken up for final disposal at the admission stage itself.

The present writ petition has been filed praying for a writ of mandamus to direct the respondents to survey the property situated in Old Survey No.483/6, New Survey No.56/6C, Olaipadi Village, Kunnam, Perambalur District and rectify the extent of the property in the field map sketch pursuant to the petitioner's representation dated 21.08.2024.

3. it is submitted by the petitioner that he had purchased the property comprised in Old Survey No.483/6, New Survey No.56/6C, measuring an extent of 1200 sq. ft. vide the sale deed dated 01.12.1986. It is submitted by the petitioner that the filed map sketch shows that the extent of the subject property is only 1010 sq. ft., instead of 1200 sq. ft. In view thereof, the petitioner has taken out an application for survey of the land and also to rectify the FMB sketch.

the respondents would submit that the survey would be conducted and boundary stones would be laid and rectification, if any, in the FMB sketch would be carried out, after putting the petitioner, adjacent owners and any other interested parties on notice. The aforesaid exercise would be carried out within a period of twelve weeks from the date of receipt of the uploaded copy of the order. The same is accepted to by the learned counsel for the petitioner.

5. Recording the submissions made by the learned Special Government Pleader, the present writ petition stands disposed of. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law. There shall be no order as to costs.
