O R D E R

This writ petition is filed for issuance of a writ of mandamus to direct the respondent to consider and pass orders on the petitioner's application for the

grant of Contract Carriage Maxi cab permit in respect of vehicle number TN02/AL-4576 dated 14.05.2025 forthwith.

2. Mrs.C.Meera Arumugam, learned Additional Government Pleader takes notice for the respondent and with the consent of both side counsels the main writ petition is taken up for disposal.

3. The case of the petitioner is that he is a Driver by profession. On 14.05.2025, he applied for a fresh maxi cab permit for his van. On 19.05.2025 the respondent directed the petitioner to produce the vehicle for inspection before the motor vehicle inspector and on 02.06.2025 the petitioner produced the van for inspection but the respondent has not issued the permit to run the vehicle. The petitioner has purchased the van under hire purchase agreement and paying monthly dues to the financier without operating the vehicle. The respondent received the application but till has not issued the permit to the petitioner. Hence, the petitioner has come forward with the present writ petition.

4. Heard both sides and perused the materials available on record.

5. It is seen that the petitioner purchased a second hand maxi cab and applied for a fresh maxi cab permit for the said vehicle. Though the respondent

received the petitioner's application no action was taken for grant of permit for the said vehicle. Since the vehicle is lying idle and the petitioner is forced to pay the monthly dues to the financier without operating the vehicle, he is put to financial loss. In view of the facts and circumstances of the case, I am inclined to direct the respondent to consider the petitioner's application dated 14.05.2025, and pass appropriate orders on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order.
