ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the 1st respondent herein to pass award and pay the compensation and with interest to the petitioner's superstructure under the provisions of the Tamil Nadu Industrial Purposes Act (Act 10 of 1999) as per the Memorandum of Agreement signed by the 1st respondent on November 2017 and based on the petitioner's representation dated 27.02.2024.

2. The learned counsel appearing for the petitioner would submit that the petitioner's building was demolished for the convenience of the CMRL without acquiring the subject land. However, the possession of the subject land is with the petitioner therefore, the petitioner made a representation dated 27.02.2024 for the purpose of compensation however, the same is not disposed of yet. Hence, the present writ petition is filed.

3. The learned counsel appearing for the CMRL would fairly submit that the building was demolished but the same was not acquired and therefore, the respondent has not paid the compensation.

4. Heard the learned counsel appearing for the petitioner as well as the respondent and perused the material available on record.

5. In the present case, it appears that there is no dispute on the aspect that the petitioner's super structure was demolished. In the event the petitioner's land is not acquired for the purpose of CMRL, I am unable to understand why the super structure is demolished and the demolition of the super structure clearly depicts that it is for the convenience of the CMRL project.

6. In such view of the matter, certainly, the petitioner is entitled for compensation for the super structure demolished by the CMRL. Hence, when the petitioner made a representation dated 27.02.2024, the respondents are supposed to have considered and pass orders but they failed to do so.

7. Hence, this Court directs the 1st respondent to determine the compensation for the super structure that has been demolished, pay the same to the petitioner along with interest and pass appropriate orders by considering the

petitioner's representation dated 27.02.2024 within a period of twelve weeks from the date of receipt of a copy of this order.

8. Accordingly, this Writ Petition is disposed of with the above terms. No costs.
