O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the respondent to deal with the representation made by the petitioner on 20.11.2024 wherein the petitioner has sought for issuance of death certificate of her late husband M.Nagarajan.

2. Heard Mr.N.Kalidoss, learned counsel for petitioner and Mr.G.Velu, learned Additional Government Pleader appearing for respondent.

3. The case of the petitioner is that her husband M.Nagarajan died on 20.01.2023. This incident took place at Kuthampakkam village, Tiruvallur district. The petitioner did not apply for the death certificate on time. Hence, the application submitted before the Tahsildar, Puliyankulam, was directed to be filed before the respondent. Hence, the petitioner submitted the application on 20.11.2024 before the respondent. Since the same was not considered, the present writ petition has been filed before this Court.

4. Section 13 of the Registration of Births and Deaths Act, 1969 read along with Rule 9 of Tamil Nadu Registration of Births and Deaths Rules, 2000, makes it clear that where any birth or death has not been registered within one year of its occurrence, the same shall be placed before the Revenue Divisional Officer and necessary charges must be paid to enable the authority to pass orders.

5. In view of the above, there shall be a direction to the respondent to act upon the application submitted by the petitioner on 20.11.2024, conduct enquiry and take a decision within a period of four

(4) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
