The petitioners, who were arrested and remanded to judicial custody on 17.07.2022 for the offences punishable under Sections 147, 148, 294(b), 323, 324, 307, 506(ii) IPC in Crime No.417 of 2012, seeks bail.

2. The case of the prosecution is that, due to previous enmity, the petitioners along with other accused assaulted the defacto complainant using deadly weapons, due to which, the deceased sustained grievous injuries and got admitted in the hospital. Hence, the case.

3. The learned counsel for the petitioners would submit that the petitioners have been falsely implicated in this case. That apart, the petitioners have been suffering incarceration from 17.07.2022. Hence, he prays for grant of bail to the petitioners.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that injured person is still taking treatment as inpatient in hospital. Hence, he vehemently opposed to grant bail to the petitioners.

5. Considering the gravity of the offence committed by the petitioners and also considering that injured person has not yet discharged from the hospital, this Court is not inclined to grant bail to the petitioners.
