These petitions are filed (i) to condone the delay of 3169 days in filing the petition to set-aside the order of abatement caused due to the death of the first respondent (ii) to set-aside the order of the abatement caused due to the death of the first respondent (iii) to bring on record the legal heir of the deceased first respondent and rank him as third respondent in the above Appeal Suit.

2. Though the name of the proposed respondent is printed in the cause list, there is no representation on his behalf.

3. Having satisfied with the reasons assigned in the affidavit filed in support of these petitions, these petitions are allowed.

4. The Registry is directed to carryout necessary amendments in the Appeal Suit No.7 of 2011 and list the same for final hearing after three weeks.
