.. Respondent Petition filed under Section 11 (5) of the Arbitration and Conciliation Act, 1996, to appoint an Arbitrator in respect of the disputes and differences that have arisen in terms of clause 35 of the agreement dated 18.09.2007 entered into between the petitioner and the respondent.

O R D E R

On hearing the learned counsel for parties, it transpires that there is only dispute on merits as neither the existence of disputes nor the existence of the arbitration clause nor the jurisdiction of this Court is disputed. In view thereof, learned counsel for the parties state that an Advocate may be appointed as the Arbitrator to enter upon reference and adjudicate the disputes inter se the parties and that the arbitration proceedings take place under the aegis of the Madras High Court Arbitration Centre.

2.Thus, as proposed and agreed, I appoint Mr.V.G.Suresh Kumar, Advocate, residing at No.801, Poonamallee High Road, Arumbakkam, Chennai 600 106, Mob.No.: 98403 87117, as the Sole Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties. As requested, the arbitration proceedings will be conducted under the aegis of the Madras High Court Arbitration Centre and the parties will be governed by the Rules of the Centre. 3.The original petition is, accordingly, allowed, leaving the parties to bear their own costs.
