Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Certiorarified Mandamus, calling for the records relating to the proceedings of the first respondent in Na.Ka.No.83/1218/2015, dated 08.04.2015 and quash the same and consequently to direct the first respondent to measure and identify the petitioner's property comprised in survey No.58/4A, Mohur Village, Kallakurichi, Villupuram District with the help of Police protection by the 3rd respondent within a time frame as may be fixed by this Court.

O R D E R

This Writ Petition has been filed challenging the impugned order passed by the first respondent dated 08.04.2015 refusing to survey the subject property as requested by the petitioner.

2. When the matter was called for hearing, Mr.Annai Ezhil, learned Government Advocate, appearing on behalf of respondents submitted that the first respondent has now called the parties for an enquiry on 17.12.2020 at 11.00 A.M. The learned counsel https://hcservices.ecourts.gov.in/hcservices/

further submitted that after conducting the enquiry, the survey will be conducted on 20.12.2020 at 10.00 AM.

3. Taking into consideration the facts and circumstances of the case and also of the fact that the first respondent has already called the parties for an enquiry and decided to survey the property, there shall be a direction to the first respondent to give opportunity to all the parties concerned and complete the entire process strictly in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

4. This Writ Petition is disposed of with the above directions. No costs.
