O R D E R

The petitioner has come forward with this writ petition, challenging the order dated 02.09.2008 of the second respondent by which the second respondent issued the charge memo as against the petitioner under Rule 17(b) of the Tamil Nadu Civil Services ( Discipline and Appeal) Rules. It appears that the petitioner was departmentally proceeded with by the respondents for certain delinquencies. It is also seen from the affidavit filed in support of the Writ petition that the petitioner was due for retirement on 31.08.2010.

At the time, when this writ petition was taken up for admission, this Court had granted an interim stay on 16.12.2008. Subsequently, the petitioner was ordered to be reinstated in to service, by the Government, by passing the order in G.O.M.(2D). No.244 Revenue Department dated 21.05.2009, thereby, the Government has dropped all further proceedings as against the petitioner.

3. In view of the above said G.OM.(2D).No.244 Revenue Department dated 21.05.2009, being issued the relief sought for in this Writ petition has become infructuous. Hence, the Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
