dated 25.09.2015 in MP No.2 of 2015) .....Respondents PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the 3rd respondent relating to the proceedings in No.1909/A1/2012, dated 12.06.2012, quash the same and consequently, direct the 4th respondent to delete the entries and annulling the registered instrument dated 10.09.2009 registered as document No.3541/2009 within the time to be stipulated by this Court and validate the same in accordance with law.

O R D E R
This writ petition has been filed, challenging the impugned proceedings dated 12.06.2012 of the 1st respondent herein and direct the 4th respondent to delete the entries and annulling the registered instrument dated 10.09.2009 registered as document No.3541/2009 within the time to be stipulated by this Court and validate the same in accordance with law.
2. The case of the petitioners is that the petitioners 1 and 2 are husband and wife and the 5th respondent is the father of the 1st petitioner. The 5h respondent claimed that he is the owner of the property in Survey Nos.483, 485, 486 and 496, and further alleged that as if the petitioner had created forged documents and grabbed the property from the 5th respondent vide document
Nos.2521/2008, 10359/2008 and 3541/2009. Thereafter, he filed a complaint before the 3rd respondent under Sections 82 and 83 of the Tamil Nadu Registration Act. Pursuant to the same, the 3rd respondent passed an impugned order annulling the registered settlement deed dated 10.09.2009, registered as document No.3541 of 2008 in the office of the Sub Registrar, Konnur. Challenging the same, the present writ petition has been filed.

The learned counsel for the petitioner would submit that for the very same issue, already the petitioner has filed a suit in O.S No.170 of 2014 before the District Munsif Court, Ambattur as against the 5th respondent and the legal heirs and the same is pending consideration. Hence, this Court may close the writ petition by observing that the impugned order shall be subject to the outcome of the pending civil suit.
4. Recording the same, this writ petition is dismissed, with liberty to the petitioner to canvass all the points in the pending suit. Consequently, connected miscellaneous petitions are closed.
