The present miscellaneous petition has been filed seeking to condone the delay of 23 days in filing the appeal against judgment dated 08.12.2022 passed in S.T.C.No.1719 of 2016 on the file of the learned Judicial Magistrate, Udhagamandalam.

2. Though the respondent has been served, he has not entered appearance either in person or through counsel.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
