Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of mandamus directing the respondents to include the service rendered by the petitioners from initial appointment till regularisation for the pension purpose.

ORDER
The petitioners in the above writ petition pray for a direction to the respondent to include the service rendered by them from the date of their initial appointment till their regularisation in service for the purpose of counting the said period for pensionary purpose and grant consequential benefits.
2. The matter is listed today at the instance of a letter being circulated to the Registry by the 4th petitioner herein. However, when the matter is taken up for hearing, there is no representation for the petitioners. The matter being of the year 2014 and pleadment was made through the letter by the petitioners for listing and disposal of the matter, this Court is inclined to take up the matter on merits and dispose of the same. In such view of the matter, as the telephone number of the petitioner, who had written the letter, was available, this Court tried to contact the 4th petitioner over phone and inspite of several attempts, the petitioner's line was busy. However, after sometime, the 4th petitioner, who had circulated the letter to the Registry returned the call and after hearing the side of the petitioners, this Court heard the learned Special Government Pleader appearing for the respondents.

Learned Special Government Pleader appearing for the respondents fairly conceded that the issue in the writ petition is squarely covered by the order passed by this Court in a series of writ petitions, which has been affirmed by this Court in the writ appeal. Attention of this Court was drawn to the orders passed in W.A. Nos.882 of 2017, etc. Batch, wherein the order passed in the writ petition impugned therein was confirmed by the Division Bench. Accordingly, it is submitted that similar order be passed in the present petition as well.
4. In view of the submission made by the learned Special Government Pleader appearing for the respondents, this writ petition is disposed of in terms of the order passed in W.A. Nos.882/2013, etc., Batch directing the respondents to count 50% of the service rendered by the petitioners from their initial
appointment till regularisation along with their regular service for the purpose of pensionary benefits and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs.
