C.M.P.No.14203 of 2023 in W.A.No.SR71442 of 2023 R.MAHADEVAN, J.

AND MOHAMMED SHAFFIQ, J.

This civil miscellaneous petition has been filed by the petitioner seeking to condone the delay of 41 days in filing the above appeal. 2.

Heard Mr.S.N.Ravichandran, learned counsel for the petitioners, who submitted that the order under challenge was passed on 31.03.2023 in W.P.No.10086 of 2023 at the admission stage itself and immediately, after getting intimation about impugned order, the writ appeal was filed on 05.06.2023, but, the certified copy of the said order was made ready only on 29.05.2023 and therefore, the delay is not on the part of the appellants. 3.

Mrs.Mythreye Chandru, learned Special Government Pleader takes notice for the respondents 2 to 6 and submitted that she has no objection in condoning the delay.

4.

We perused the records and it appears that there is no delay actually caused by the appellants when the certified copy of the impugned order was made ready only on 29.05.2023.

5.

Having regard to the reasons stated in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned and this petition is accordingly ordered.
